Terms and Conditions for Delivered Catering
Acceptance of your quote indicates acceptance of these Terms and Conditions for delivered catering.
For events and weddings, please refer to the Terms of Service emailed to you.
1. Price
All prices are GST exclusive unless otherwise stated. The price of goods supplied are as per Food Envy’s published price list or specific quoted order price (whichever is applicable).
2. Ordering and confirmation
2.1 To ensure your order is prepared and delivered on time, Food Envy requires all orders to be placed and/or quotation accepted as per Clause 2.2.
2.2 Cut-off times for ordering/quotation acceptance are as follows:
Delivery for Monday - 12 noon Thursday prior
Delivery for Tuesday - 12 noon Friday prior
Delivery for Wednesday - 12 noon Monday
Delivery Thursday - 12 noon Tuesday
Delivery Friday - 12 noon Wednesday
Delivery for Saturday - 12 noon Wednesday
Delivery for Sunday - 12 noon Wednesday
2.3 Any orders taken after that time will be considered Late Ordering (Clause 3), and additional charges will apply.
2.4 A minimum order of $750 ex GST is required for weekend delivery, excluding delivery fees.
2.5 All menus are subject to availability and we will make any substitutes closest to the original value as possible. We reserve the right to substitute ingredients or menu items if necessary. We will inform you if this is the case.
2.6 Food Envy has the right to not accept an order.
3. Late Ordering
3.1 While all efforts will be made to accommodate orders placed after the cut-off time (Clause 2.2) and within 24 hours of delivery, Food Envy will only confirm an order that fits in with existing client deliveries.
3.2 Any orders placed after the cut-off time (Clause 2.2) and within 24 hours of the delivery time will incur a $35 charge or 7.5% surcharge to the overall order, whichever is greater, excluding the delivery charge.
3.3 Orders less than 24 hours before delivery time may not be accepted.
4. Changes to a Confirmed Order
4.1 Any changes to your order from the cut-off time (Clause 2.2) to 24 hours before the delivery time will incur a $35 charge or 7.5% surcharge to the overall order, whichever is greater, excluding the delivery charge.
4.2 Any changes to your order less than 24 hours before the delivery time will incur a 15% surcharge to the overall order, excluding the delivery charge.
4.3 Any decrease in your order after the cut-off time will not result in a reduction in your final invoice.
4.4 Food Envy reserves the right to offer “Chefs Choice” of menu for late or changes to any orders. If you decide to choose your own menu, Food Envy may not be able to cater to your request or a surcharge will apply.
5. Cancellation
5.1 If your plans change and you need to cancel your order, please contact us immediately.
5.2 Cancellation of your order from the cut-off time (Clause 2.2) to 24 hours before the delivery time will incur 50% cancellation charge, minus the delivery charge.
5.3 Cancellation of your order less than 24 hours before the delivery time will incur 100% cancellation charge, minus the delivery charge.
6. Delivery and Collection
6.1 Food Envy’s delivery fees are automatically calculated based on your location, catering order and requirements.
6.2 All catering will be delivered by Food Envy on supplied crockery/or any relevant additional equipment. All crockery and equipment will be collected by Food Envy the following business day for any CBD orders. Collections outside of the CBD will come at an additional delivery charge and will be arranged for a suitable time.
6.3 Any crockery or equipment that is damaged or missing will be invoiced at the full replacement cost.
6.4 Requests for same day crockery or equipment collection will incur an additional delivery fee calculated based on your location, catering order and requirements.
6.5 The client must ensure that a person is available for Food Envy to collect crockery and equipment if there is restricted access. You will be charged a delivery fee if we are unable to collect our equipment due to inaccessibility.
6.6 Pick ups from the Food Envy office are an alternative to delivery. Collection times must be within office hours.
7. Dietary Requirements, Allergens & Serious Health Risks
7.1 Please notify us of dietary requests when placing your order. Dietary requirements may incur additional charges depending on items ordered, outlined on our menu and will be itemised separately on quotes and invoices.
7.2 Custom items may be necessary for complex dietary needs. Custom items will incur additional charges and is at our discretion, however we will aim to match the clients per person budget allocation.
7.3 Guests with high risk dietary requirements must sight and approve the alternative menu that we propose. It is preferred that guests suggest safe menu items that we may be able to prepare.
7.4 Our kitchen handles nuts, seeds, sesame, eggs, dairy and gluten products. Due to unintentional cross-contamination, we cannot guarantee that our food items are completely free of those products.
7.5 Food Envy reserves the right to reject dietary requests if we feel that we cannot safely cater for a dietary requirement.
8. Health & Safety/ Food Handling
8.1 Hot items are delivered hot and ready to serve, unless requested to be delivered cold, or where you have requested multiple meal deliveries for the one delivery time. Food should be kept refrigerated until required.
8.2 Food Envy will not be held liable for the health and safety of our customers whereby food has not been chilled / reheated as per instructions, or consumed more than 30 minutes after the specified service time. Please refer to our ‘Guide to storing and reheating your catering’ as part of these terms and conditions.
9. Payment
9.1 For catering supplied between Monday and Friday, an invoice will be sent following the date of delivery.
9.2 For catering supplied on Saturday and Sunday, an invoice will be sent on Monday.
9.3 Payment terms are strictly 7 days following the event unless otherwise agreed upon.
10. Disputes & Credits
Disputes and credits will only be considered valid if brought to Food Envy’s attention within 3 working days of the date of supply. Credits will not be given for procured goods.
